Terms of Service
Terms of Service
OVERVIEW
Welcome to Aveloya.
These Terms of Service ("Terms") govern your access to and use of aveloya.com, including our website, online store, products, services, content, features and tools (collectively, the "Services").
The terms "Aveloya", "we", "us" and "our" refer to Aveloya. The terms "you" and "your" refer to the person accessing or using our Services.
Aveloya uses Shopify to operate our online store and provide certain aspects of the Services.
Please read these Terms carefully before using our Services or placing an order. By accessing or using our Services, you agree to these Terms and our Privacy Policy.
If you do not agree with these Terms, please do not use or access our Services.
These Terms do not affect any rights you have under applicable consumer protection law that cannot legally be excluded or restricted.
SECTION 1 — ELIGIBILITY AND ACCOUNT
By using our Services, you confirm that you are legally capable of entering into a binding contract under the laws applicable to you.
If you create an account with us, you are responsible for providing accurate, current and complete information.
You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.
You must notify us promptly if you believe your account has been accessed without your permission.
We reserve the right to suspend or terminate an account where we reasonably believe that the account has been used unlawfully, fraudulently, abusively or in violation of these Terms.
SECTION 2 — OUR PRODUCTS
We make reasonable efforts to ensure that product descriptions, photographs, colours, measurements and other information displayed on our website are accurate.
However, colours may appear differently depending on your device, screen settings and other technical factors.
Product photographs are provided for illustration purposes, and minor differences in appearance may occur.
Nothing in these Terms excludes or limits your statutory rights relating to products that are faulty, unsafe, not as described, or otherwise fail to meet applicable legal requirements.
We may update product information from time to time.
We may discontinue products or change available quantities, provided that this does not affect an order that we have already accepted except where permitted by law.
SECTION 3 — ORDERS AND CONTRACT FORMATION
When you place an order through our website, you are making an offer to purchase the selected products.
After placing an order, you will normally receive an order acknowledgement confirming that we have received your order. This acknowledgement does not necessarily mean that your order has been accepted.
A contract between you and Aveloya is formed when we confirm acceptance of your order, normally by sending an order confirmation.
We may refuse or cancel an order before acceptance where, for example:
-
the product is unavailable;
-
there is an obvious pricing or product information error;
-
we reasonably suspect fraud or unauthorised activity;
-
the order cannot be fulfilled;
-
we are unable to obtain payment; or
-
cancellation is otherwise permitted by law.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled order using the original payment method, subject to applicable law.
Once an order has been accepted, cancellation rights will be governed by applicable law and our Refund & Returns Policy.
Nothing in these Terms affects your statutory cancellation or consumer rights.
SECTION 4 — PRICES AND PAYMENT
All prices displayed on our website are shown in the currency indicated at checkout.
Prices may change from time to time. However, changes made after you have placed an order will not affect the price of an order that we have already accepted, except where permitted by law.
The total price payable, including applicable delivery charges and any other charges that we are required to disclose before you place your order, will be shown at checkout.
Where applicable, taxes may be included in the displayed price or calculated at checkout depending on the destination and applicable tax requirements.
For international orders, customs duties, import taxes or other charges may apply depending on the destination country. Where such charges are payable by the customer, we will provide information about them where required by applicable law.
You must provide accurate and complete billing and payment information.
By submitting payment information, you confirm that you are authorised to use the selected payment method.
Payments are processed through Shopify and/or third-party payment providers. Aveloya does not normally store complete payment card details.
SECTION 5 — SHIPPING AND DELIVERY
We will provide the available delivery options and applicable delivery charges at checkout or before you place your order.
Delivery times shown on our website are estimates unless we expressly state otherwise.
We will make reasonable efforts to dispatch and deliver orders within the stated delivery period.
For UK consumer orders, where no different delivery period has been agreed, goods will generally be delivered without undue delay and within the legally applicable period.
We are not responsible for delays caused by events outside our reasonable control, such as severe weather, strikes, customs delays, carrier disruption, natural disasters or other events beyond our reasonable control.
However, nothing in these Terms limits your legal rights where we fail to deliver within a legally required period.
For consumer purchases, risk of loss or damage to the goods generally remains with Aveloya until the goods come into the physical possession of you or a person you have identified to receive them, unless applicable law provides otherwise.
SECTION 6 — RETURNS, REFUNDS AND CANCELLATIONS
Our returns and refunds are governed by our Refund & Returns Policy.
You may have statutory rights to cancel an online order, including a statutory cooling-off period where applicable.
In addition to your statutory rights, Aveloya offers a 30-day return policy subject to the conditions set out in our Refund & Returns Policy.
Nothing in our Refund & Returns Policy or these Terms limits or excludes any consumer rights that cannot legally be excluded.
For more information, please see our Refund & Returns Policy.

You may access and use our Services for personal and lawful purposes.
You must not, without our prior written permission:
-

Nothing in these Terms transfers ownership of any intellectual property to you.
The Aveloya name, logo, product names, designs and slogans may constitute trademarks of Aveloya or their respective owners.
Shopify's trademarks remain the property of Shopify.
SECTION 8 — THIRD-PARTY SERVICES AND OPTIONAL TOOLS
Our Services may include functionality provided by third-party service providers.
These services may include payment processing, analytics, reviews, advertising, shipping, social media functionality and other tools.
We are not responsible for third-party services that we do not control.
Your use of third-party services may also be subject to the third party's own terms and privacy policies.
Where third-party functionality is necessary for us to provide our Services, we will use reasonable efforts to maintain the functionality of our website.
SECTION 9 — THIRD-PARTY LINKS
Our website may contain links to websites, applications or services operated by third parties.
These links are provided for convenience and do not necessarily constitute an endorsement by Aveloya.
We are not responsible for the content, security, privacy practices or availability of third-party websites.
If you choose to access a third-party website, you do so subject to that third party's own terms and policies.
SECTION 10 — RELATIONSHIP WITH SHOPIFY
Aveloya uses Shopify to operate and provide our online store.
However, purchases made through our website are transactions between you and Aveloya.
Shopify provides the technology and infrastructure that enables us to operate the store but is not the seller of the products purchased from Aveloya.
To the fullest extent permitted by law, Shopify is not responsible for the products sold by Aveloya or for disputes arising directly between you and Aveloya concerning those products.
Nothing in this section limits any rights or remedies you may have against Aveloya or Shopify under applicable law.
SECTION 11 — PRIVACY
Your use of our Services is also subject to our Privacy Policy.
Our Privacy Policy explains how we collect, use, store and disclose personal information.
You can review our Privacy Policy on our website.
Shopify may separately process personal information in connection with providing its services. Shopify's own privacy practices are described in Shopify's applicable privacy policy.
SECTION 12 — REVIEWS AND FEEDBACK
If you submit reviews, comments, photographs, suggestions, ideas or other content to Aveloya ("Feedback"), you confirm that you have the right to submit that content.
You must not submit content that:
-
infringes another person's intellectual property or privacy rights;
-
is unlawful, fraudulent, threatening or defamatory;
-
contains malicious software;
-
impersonates another person;
-
contains misleading information; or
-
violates these Terms.
By submitting Feedback, you grant Aveloya a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and publish that Feedback for purposes connected with operating, improving and promoting our Services.
This licence does not transfer ownership of your Feedback to Aveloya.
We may remove or refuse to publish Feedback that we reasonably believe violates these Terms or applicable law.
We do not guarantee that all submitted Feedback will be published.
SECTION 13 — ACCURACY OF INFORMATION
We aim to keep the information on our website accurate and up to date.
However, occasional typographical errors, inaccuracies or omissions may occur, including in relation to:
-
product descriptions;
-
prices;
-
promotions;
-
availability;
-
delivery information; or
-
other website content.
Where we identify an error before an order has been accepted, we may correct the error and, where appropriate, contact you before proceeding.
If an obvious error affects an order that has already been placed, we will contact you and explain the available options where required by law.
Nothing in this section allows us to cancel or alter an accepted consumer contract in a way that would be unfair or unlawful.
SECTION 14 — PROHIBITED USE
You may use our Services only for lawful purposes.
You must not:
-
use the Services for fraudulent or unlawful purposes;
-
interfere with the operation or security of our website;
-
upload malicious code, viruses or other harmful material;
-
attempt to gain unauthorised access to our systems;
-
impersonate another person or business;
-
collect personal information from other users without lawful authority;
-
use our website to send spam or phishing messages;
-
infringe our intellectual property rights or the rights of others;
-
systematically scrape or copy our website content;
-
use automated systems to access our Services in a manner that causes excessive load, circumvents technical restrictions or violates our published instructions; or
-
otherwise use the Services in a way that could damage Aveloya, our customers or our service providers.
We may restrict or suspend access to our Services where reasonably necessary to protect our website, customers, business or legal rights.
SECTION 15 — AUTOMATED ACCESS AND AGENTS
Automated tools, bots, crawlers and AI agents must not access or interact with our Services in a manner that:
-
bypasses security or access controls;
-
circumvents technical restrictions;
-
ignores robots.txt or other published technical instructions;
-
places unreasonable load on our systems;
-
collects personal information unlawfully;
-
copies substantial amounts of website content without permission; or
-
otherwise interferes with our Services.
We may use technical measures to limit automated access where necessary.
Nothing in this section prevents lawful search engine indexing or other automated activity that we expressly permit.
SECTION 16 — SUSPENSION AND TERMINATION
We may suspend or restrict access to our Services where reasonably necessary, including where we believe there has been:
-
unlawful activity;
-
fraud;
-
abuse;
-
a security threat;
-
a serious breach of these Terms; or
-
conduct that may harm Aveloya, our customers or our systems.
Where appropriate and reasonably possible, we will provide notice before restricting access.
Termination or suspension does not affect rights or obligations that arose before the termination.
SECTION 17 — OUR RESPONSIBILITY TO YOU
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits our liability for:
-
death or personal injury caused by our negligence;
-
fraud or fraudulent misrepresentation;
-
defective products where liability cannot legally be excluded;
-
products that are not as described;
-
breach of statutory consumer rights; or
-
any other liability that cannot legally be excluded or limited.
Subject to the above, and to the fullest extent permitted by law, Aveloya will not be liable for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control.
Nothing in these Terms affects your statutory rights as a consumer.
SECTION 18 — PRODUCTS AND STATUTORY RIGHTS
Our products are supplied subject to applicable consumer protection law.
For UK consumers, goods must meet the standards required by applicable law, including being of satisfactory quality, fit for purpose and as described where those requirements apply.
If a product is faulty, defective, not as described or otherwise fails to meet applicable legal requirements, you may have statutory rights in addition to any voluntary return policy offered by Aveloya.
These statutory rights are not affected by these Terms.
SECTION 19 — EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for failure or delay in performing our obligations where the failure or delay results from circumstances outside our reasonable control.
Examples may include:
-
natural disasters;
-
severe weather;
-
war;
-
terrorism;
-
government action;
-
strikes or industrial disputes;
-
major transport disruption;
-
internet or telecommunications failures;
-
cyber incidents affecting third-party infrastructure; or
-
other events that we could not reasonably prevent or overcome.
This section does not affect your statutory rights, including any rights relating to refunds or cancellation.
SECTION 20 — INDEMNIFICATION
If you use our Services for business or commercial purposes, you agree to compensate Aveloya for reasonable losses, liabilities and costs arising directly from your unlawful use of the Services or your serious breach of these Terms, to the extent permitted by law.
Nothing in this section imposes liability on a consumer for exercising lawful consumer rights or restricts rights that cannot legally be restricted.
SECTION 21 — SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it lawful and enforceable where possible.
If this is not possible, the affected provision will be treated as removed, without affecting the validity of the remaining provisions.
SECTION 22 — NO WAIVER
If we do not immediately enforce a right or provision under these Terms, this does not mean that we have permanently waived that right or provision.
Any waiver must be expressly made by us.
SECTION 23 — ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund & Returns Policy, Shipping Policy and any other policies expressly incorporated into these Terms, form the agreement governing your use of our Services.
Where applicable, information provided to you before you place an order also forms part of the contract as required by law.
Nothing in these Terms removes or limits any statutory rights you may have.
SECTION 24 — ASSIGNMENT
You may not transfer your rights or obligations under these Terms where doing so would be contrary to applicable law or without our consent where consent is required.
We may transfer our rights and obligations to another business in connection with a merger, acquisition, restructuring or sale of our business, provided that your legal rights are not adversely affected.
SECTION 25 — GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of England and Wales, except where mandatory consumer protection laws in your country of residence provide otherwise.
If you are a consumer, you may also have rights to bring proceedings under the mandatory laws or jurisdictional rules applicable to your place of residence.
Nothing in this section limits any mandatory consumer rights or protections available to you under applicable law.
SECTION 26 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business practices, legal requirements or other legitimate reasons.
The most current version will be posted on our website with the updated "Last updated" date.
Where required by law, we will provide notice of material changes.
Changes will not retroactively alter the terms of an order that has already been accepted, except where permitted by law.
